Information document on liquid household waste
According to the requirements of current Ukrainian legislation, specifically Part 2 of Article 35-1 of the Law of Ukraine "On Waste" and the Rules for Provision of Household Waste Collection Services approved by Resolution of the Cabinet of Ministers of Ukraine No.1070 dated December 10, 2008, owners, tenants, users, including lessees, and holders of residential buildings, land plots, sources of household waste generation are obligated to enter into contracts with a legal entity designated as the service provider for the collection of household waste and to make payments for such services.
By the decision of the Odessa City Council dated November 8, 2017, No.2597-VII "On the determination of a legal entity for competitive provision of liquid household waste collection and transportation services within the city of Odessa" and the protocols of the competition commission meetings dated February 20, 2018, No.1 and No.2, Order of the Department of Municipal Economy dated February 23, 2018, No.22, the branch "Infoksvodokanal" LLC "Infoks" was recognized as the service provider for the collection of liquid household waste in Odessa.
By decision of the Executive Committee of the Odessa City Council dated October 25, 2018, No.436, tariffs for the collection of liquid household waste were set at 98.80 UAH/m3.
These tariffs came into effect on December 1, 2018. Considering the approved minimum daily water consumption rates per person (25 liters), charges for the collection, transportation, and processing of liquid household waste (collection, transportation, and processing of liquid household waste) for residents of non-sewered private sector residential buildings in Odessa amount to 75.14 UAH/month per person (including VAT).
Article 20 of the Law of Ukraine "On Housing and Communal Services" stipulates that the consumer is obliged to conclude a contract for the provision of housing and communal services prepared by the service provider based on a standard contract.
According to paragraph 7.2 of the Rules for the Improvement of the Territory of Odessa, approved by the decision of the Odessa City Council dated December 23, 2011, No.1631-VI, the absence of a contract for the collection of household waste with specialized organizations by citizens who own or use premises (buildings, structures) constitutes a violation of these Rules.
ATTENTION!!!
The absence of a contract for the collection of household waste is a violation of the Laws "On Waste," "On Housing and Communal Services," "On Improvement of Settlements," and the Rules for the Improvement of the Territory of Odessa, which entails administrative liability in the form of a fine.
In case of failure to conclude a contract, the branch "Infoksvodokanal" has the right to apply to the court to oblige the parties to conclude a contract for the provision of services for the collection of liquid household waste, with all court costs borne by those who fail to conclude the contract voluntarily.
According to paragraph 2.2.6 of the Methodological Recommendations for the Organization of Collection, Transportation, Processing, and Utilization of Household Waste, approved by the Ministry of Housing and Communal Services Order No.176 dated June 7, 2010, the use of cesspools in areas of individual residential construction with centralized water supply and sewerage is prohibited. Additionally, paragraph 2.2.5 prohibits the use of bottomless cesspools with ground filtration for untreated sewage.
According to paragraph 2.24 of the State Sanitary Norms and Rules for Maintenance of Territories of Settlements, approved by the Ministry of Health Order No.145 dated March 17, 2011, the equipment of internal household sewage systems and drainage of objects into cesspools is prohibited.
According to paragraph 10.8.4 of the State Building Norms "Sewerage External Networks and Structures Basic Provisions for Design," DBN V.2.5-75:2013, in urban areas lacking centralized or decentralized household sewage networks, water supply into buildings, internal and external sewage systems with subsequent discharge of wastewater into cesspools is prohibited.
Considering the above, to comply with current legislation norms and prevent environmental pollution, in case of failure by consumers to conclude a contract for the collection of liquid household waste, the branch "Infoksvodokanal" has the right to limit the provision of services to such consumers.
The branch "Infoksvodokanal" invites residents of Odessa who have not concluded a contract for the collection of liquid household waste to contact the "Water Supply Management" at the address: Odessa, Mikhaylivska St., 25, to conclude such a contract.
To sign the contract, the consumer needs to provide:
- Passport (copy);
- Identification code (copy);
- Family composition certificate;
- Ownership documents for the house (copies);
- Ownership documents for the land plot (copies);
- Documents confirming benefits and subsidies (copies) (if applicable);
- Documents on the volume of the cesspool for waste collection scheduling (if applicable).
